Terms of Use

These Terms of Use ("Terms") are an agreement between you and Demand Generation LLC ("we", "us") covering the Sunstir mobile app, Sunstir Pro and the Sunstir website (together, the "Service"). By downloading or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

1. Who can use Sunstir

You must be at least 13 years old (or the minimum age in your country) to use the Service. If you're under the age of majority where you live, you need a parent's or guardian's permission. You're responsible for keeping your account secure and for activity on it.

2. Your account

You sign in with Apple, Google or an emailed code. Please give accurate information and let us know if you suspect unauthorized access. You can delete your account anytime from inside the app (Settings → your account → Delete account).

3. Sunstir Pro subscriptions

• Plans: Sunstir Pro is available as a weekly, monthly or yearly auto-renewing subscription. Prices are shown in the app before you buy and may vary by country.
• Payment: payment is charged to your Apple ID or Google Play account when you confirm your purchase.
• Auto-renewal: your subscription renews automatically at the same price and length unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
• Free trials: if a plan includes a free trial, you won't be charged until it ends. Cancel at least 24 hours before the trial ends to avoid being charged. Any unused part of a trial is forfeited when you buy a subscription.
• Cancelling: manage or cancel your subscription in your App Store account settings (iPhone) or Google Play subscriptions (Android). Cancelling stops future renewals; you keep Pro until the end of the current paid period. Deleting the app or your account does not cancel your subscription.
• Refunds: purchases are processed by Apple or Google, and refund requests are handled under their policies. We can't issue refunds for App Store or Google Play purchases directly.
• Price changes: we may change subscription prices. You'll be notified in advance as required by Apple or Google, and changes apply from your next renewal.

4. Physical activity: please read

Some wake-up tasks involve physical activity, such as push-ups, squats, jumping jacks, planks, stretching, walking and spinning around. You choose which tasks to use.

• Only do tasks that are safe for you. Talk to a doctor before starting any new physical activity, especially if you have a medical condition, injury, pregnancy, dizziness or balance problems.
• You'll often be doing tasks right after waking up, when you may be groggy. Take your time, make sure you have clear space, and stop if you feel pain, faint or unwell.
• Don't use tasks in unsafe places or situations, such as near stairs, while driving or anywhere you could fall or disturb others.
• Sunstir isn't a medical, fitness or health service and doesn't give medical advice.

You take part in physical tasks at your own risk. To the extent the law allows, we're not responsible for injury resulting from them.

5. Alarm reliability

We work hard to make Sunstir wake you up reliably, but no alarm app can be guaranteed. Alarms depend on your device, operating system, settings, battery, volume, notification permissions, do-not-disturb and focus modes, and other factors outside our control. For example, on iPhone, alerts sent while the app is closed follow your ringer switch. Don't rely on Sunstir as your only alarm for anything critical, such as flights, medication, exams or work shifts. We're not liable for missed alarms or their consequences.

6. Acceptable use

Please don't:

• Copy, modify, reverse engineer or resell the Service, except where the law allows
• Interfere with, disrupt or try to gain unauthorized access to the Service or its systems
• Use the Service to break the law or infringe anyone's rights
• Use audio files or photos you don't have the right to use

7. Your content

Content you create or add, such as selfies, photos, notes and custom sounds, belongs to you and is stored on your device. You're responsible for having the rights to any audio or images you use. When you create a custom sound, you confirm you own the file or have permission to use it for personal purposes.

8. Our intellectual property

The Service, including the Sunstir name, logo, design, sounds, text and software, is owned by us or our licensors and protected by law. We give you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for your personal, non-commercial use, under these Terms and the app store's usage rules.

9. Feedback

If you send us ideas or suggestions, we may use them without any obligation to you.

10. Ending your use

You can stop using the Service at any time. We may suspend or end your access if you break these Terms or if we stop offering the Service. If we stop offering Sunstir Pro, we'll give reasonable notice where possible.

11. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we don't warrant that the Service will be uninterrupted, error-free or that alarms will always sound.

12. Limitation of liability

To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, opportunities or goodwill, arising from your use of the Service, including missed alarms or injury from physical tasks. Our total liability for any claim relating to the Service won't exceed the greater of the amount you paid us for Sunstir Pro in the 12 months before the claim, or US $50.

Some places don't allow these limits, so some may not apply to you. Nothing in these Terms limits rights you have under consumer protection laws that can't be waived.

13. Indemnity

To the extent the law allows, you agree to defend and hold us harmless from claims arising from your misuse of the Service or your breach of these Terms.

14. Apple and Google

These Terms are between you and us, not Apple or Google. Apple and Google aren't responsible for the Service or its content, and have no obligation to provide support. If you downloaded Sunstir from the App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. If the app fails to meet any applicable warranty, you may notify Apple, which may refund the purchase price (if any); Apple has no other warranty obligation. Apple isn't responsible for handling any claims about the app, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims. You confirm you're not located in a country subject to a U.S. government embargo and aren't on any U.S. government list of prohibited or restricted parties.

15. Governing law and disputes

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Fulton County, Georgia, unless the law where you live gives you the right to bring claims in your local courts. Before filing a claim, please contact us so we can try to resolve it informally.

16. Changes to these Terms

We may update these Terms from time to time. We'll change the effective date above and, for significant changes, let you know in the app or by email. If you keep using the Service after changes take effect, you accept the updated Terms.
